1Introduction — who we are and what these terms govern

These terms of use (the “Terms”) govern the rights and obligations between us as the provider and you as a user of the Amista mobile application and the related websites and interfaces (the “Service”).

We are the provider of the Service:

Amista is an app for communities and events. It lets you create a profile, set up or join communities, organise and attend events, share posts, polls and photos, chat, and discover what is happening around you.

By creating an account or using the Service, you agree to these Terms. If you do not agree with them, do not use the Service.

Use without an account. Links to invitations, events and communities (go.amista.app) open a web page that can also be viewed by someone without an account. These Terms apply to such use accordingly — in particular Articles 5, 14 and 15.

The processing of personal data is governed not by these Terms but by the Privacy Policy (amista.app/privacy). The Privacy Policy is not part of the contract; it describes how we process your data.

These Terms also include Annex A (special terms for the App Store and Google Play) and Annex B (model form for withdrawal from the contract).

2Definitions

  • Account — your user account in the Service.
  • Content — any material that you upload to the Service or make available through it: text, images, photos, GIFs, links, names, descriptions, chat messages, comments, polls and responses to them.
  • Community — a space in the Service set up by a user, which has an owner and, where applicable, admins and members.
  • Event — a one-off event, a recurring series of events, or a course and its sessions, created within a Community.
  • Organiser — a user who owns or manages a Community, or who created an Event.
  • Plan — the free or paid tier of your Account under Article 11, which determines how many Communities you can own and how many Events you can organise in one month.
  • Store — the App Store operated by Apple or Google Play operated by Google, through which in-app purchases are made.
  • DSA — Regulation (EU) 2022/2065 of the European Parliament and of the Council on a Single Market for Digital Services (Digital Services Act).

3Conclusion of the contract, age and account

3.1Age limit

The Service may be used only by persons who have reached the age of 16. By creating an Account, you declare that you meet this condition. If we find that an Account is being used by a person under 16, we will delete the Account and erase the data.

If you do not have full legal capacity, you may use the Service only to the extent appropriate to your intellectual and volitional maturity; entering into a paid contract under Article 11 requires the consent of your legal representative.

3.2Conclusion of the contract

The contract for the use of the Service between you and us is concluded at the moment you complete the registration of your Account and we give you access to it. The contract is concluded for an indefinite period and is free of charge unless you purchase a paid Plan under Article 11.

How you conclude the contract. You enter an email address and a password (or choose to sign in with Google or Apple), when registering by email you confirm the verification code we send to it, and by continuing you confirm that you are at least 16 and that you agree to these Terms. You complete the registration by filling in the basic profile details (username, name, year of birth and interests). You can correct input errors before confirming each step; you can also edit your profile details later in the app, and we will correct the others at your request.

The contract is concluded in the Slovak language. We archive its text (these Terms) in electronic form. We publish every version of the Terms permanently at its own address — this version at amista.app/terms-1-1, its English translation at amista.app/terms-1-1-en — where you can save or print it; the list of versions is at the end of the Terms. We record the version you accepted with your Account. The version in force is always at amista.app/terms.

3.3Account

  • As a rule, each person sets up one Account. An Account is non-transferable and you must not let another person use it.
  • The information you provide at registration and in your profile must be truthful. You must not impersonate another person, an organisation or us.
  • You must protect your login credentials. You are responsible for activity carried out from your Account, except where the misuse occurred for reasons on our side. Report any suspected misuse of your Account to us without delay at the contact address given in Article 1.
  • You can sign in with an email address and password or with a Google or Apple account. If you sign in through a third party, your relationship with that third party is also governed by its own terms.
  • You receive service notices (for example about a change to these Terms or a measure taken against your Account) in the app — as a notification or an in-app notice. By email we routinely send you only the verification code at registration and the password reset code. Service notices are not advertising and cannot be declined for as long as you have an active Account.

4Description of the Service

4.1Features

Depending on its current stage of development, the Service allows you in particular to:

  • maintain a profile (username, name, photo, description, links to social networks) and set its visibility and discoverability;
  • set up Communities, join them (freely, subject to approval or by invitation), and manage members and their roles (owner, admin, member);
  • create and attend Events, including recurring series and courses, confirm attendance or interest, invite others and share invitation links; an Event can be public, for Community members only or private (invited people only);
  • publish Content — posts, comments, GIFs, polls and photos. Posts and polls are seen by all members of the Community, and when publishing them you can also share them with your friends; comments, GIFs, photos and chat messages are seen by the same audience as the post, Event or chat they are in;
  • chat in Community and Event chats, including attachments, reactions and mentions;
  • make friends and block or hide users and Communities;
  • discover Content and Events based on your interests and home area, including on a map;
  • receive notifications about activity, which you can configure by category.

4.2Automated content ranking

We determine the order of Content in the feed, in discovery and on the map automatically — based on your memberships, friendships, chosen interests and the home area you have set. This is not profiling with legal effects, and we have no paid content promotion or advertising.

4.3Limits

The Service has operational and product limits — for example, the number of Communities you can own and the number of Events you can organise in one month, depending on your Plan (Article 11), the number of photos a user can upload to a single Event, the size and format of uploaded images, or the rate of calls to the interface. The current limits are shown in the Service in the relevant place; we may change them reasonably, and we will announce material changes in accordance with Article 17. We will not worsen the limits of a paid Plan during the paid period (Article 11.1).

4.4What the Service is not

The Service is a space for creating and sharing Content between users. We are not the organiser of Events, a ticket sales intermediary, a payment institution or a travel agency, and we do not guarantee the accuracy, quality or lawfulness of Content created by users (see Articles 7, 9 and 10).

5Rules of use

5.1Prohibited content

You must not upload to the Service, or disseminate through it, any Content that:

  1. is unlawful or incites unlawful conduct;
  2. incites hatred, violence or discrimination on the grounds of race, colour, sex, language, faith and religion, political or other opinion, national or social origin, membership of a national or ethnic group, disability, age or sexual orientation;
  3. harasses, intimidates, bullies, threatens or deliberately humiliates another person;
  4. depicts or promotes violence, abuse, self-harm or suicide;
  5. is sexually explicit or sexualises minors in any way (once reported, we hide Content that sexualises minors at once and, when the violation is confirmed, remove it; where we suspect a criminal offence, we report it to law enforcement authorities without delay — Article 7.3);
  6. is spam, unsolicited advertising, chain messaging, fraud, phishing or any other form of deceptive conduct;
  7. infringes copyright, rights related to copyright, trade mark rights or other intellectual property rights of third parties;
  8. interferes with another person's right to protection of personality, reputation or privacy, or discloses another person's personal data without a legal basis (so-called doxing);
  9. contains malicious code, or offers weapons, drugs or other goods and services whose offering is restricted or prohibited.

5.2Prohibited conduct

When using the Service, you must not, in particular:

  1. circumvent or interfere with the technical, security and access measures of the Service, or probe it for vulnerabilities without our written consent;
  2. place an unreasonable load on our infrastructure, carry out automated data collection (scraping) or bulk downloading of Content, or access the Service's interface other than through the official app;
  3. create fake Accounts, create Accounts in bulk or circumvent measures we have taken against you;
  4. misuse the reporting feature (Article 7.6), invitations, notifications or chat to harass or flood other users;
  5. use other users' Content beyond the purpose for which they made it available to you — in particular, republish it outside the Service without their consent;
  6. use the Service for third-party commercial offers that are unrelated to the Community or Event in which they are posted.

5.3Your declaration

You declare that the Content you upload complies with the law and these Terms and that you are entitled to make it available. If another person appears in the Content, you are responsible for having their consent to the extent necessary to publish it to the chosen audience.

6Your content and licence

6.1Content remains yours

By uploading Content to the Service, you do not transfer copyright or ownership to us — you retain all rights to your Content.

6.2The licence you grant us

So that we can technically provide the Service, you grant us, under Section 65 et seq. of Act No. 185/2015 Coll. (the Copyright Act), a non-exclusive, royalty-free, worldwide licence to use your Content to the extent necessary to operate the Service, namely for:

  • making a copy and storing it in our systems and with the providers listed in the Privacy Policy,
  • making the Content available to the audience determined by the Service — by your choice or by the post, Event, chat or Community in which you publish the Content, including later changes made to them by their admins (for example, a change to an Event's access mode),
  • the technical processing necessary for display — in particular changing the format, size and quality of images, creating thumbnails and crops, delivery via a content delivery network and caching,
  • backup and restoration from backup,
  • keeping and using the Content for moderation, handling reports and complaints, complying with legal obligations and establishing or defending legal claims, for the periods set out in the Privacy Policy.

The licence does not permit any other use — in particular, we will not use your Content for advertising, sell it or make it available to third parties beyond the above.

You also grant the licence with the right to grant sublicences to the providers listed in the Privacy Policy, exclusively for the purposes stated above.

6.3Duration of the licence

The licence ends upon deletion of the Content or deletion of the Account; for keeping the Content under the last point of Article 6.2, it lasts for the periods set out in the Privacy Policy. Removal from operational systems and from backups takes place within the time limits set out in the Privacy Policy. Please note that:

  • other users may have saved or photographed Content made available to them, and we cannot technically prevent this;
  • sent messages may remain in the local copy of the chat on the devices of the other participants in the conversation;
  • we may keep Content that forms part of other users' conversation or Community in anonymised form (for example, “message was deleted”) so that the conversation still makes sense.

6.4Feedback

If you send us a suggestion, idea or comment about the Service, we may use it free of charge without incurring any obligation towards you. This does not affect any intellectual property rights you may have in a separate work that you provide to us.

7Content moderation, reports and measures

This Article contains information about the restrictions we impose in relation to users' Content and about the moderation procedures, measures and tools, including automated decision-making, in accordance with Art. 14 DSA.

7.1Our role

We do not create users' Content or assess it before it is published — except for the automatic prohibited-words filter for usernames and for Community and Event names (Article 7.3). We act as a provider of a hosting service within the meaning of Art. 6 DSA and have no general obligation to monitor Content or to actively seek out illegal activity (Art. 8 DSA). The person who uploaded Content is responsible for it.

Chat in Amista is not end-to-end encrypted. Messages are stored on our servers in readable form. No one routinely reads them, but if someone reports a message, post, comment, photo, Event, profile or Community, an authorised person will view the reported Content solely for the purpose of handling that report and to the extent necessary for it — including Content in a private Community or in an Event chat. Details are in the Privacy Policy.

7.2Reporting Content (mechanism under Art. 16 DSA)

Directly in the app you can use the “Report” feature to report a post (including a poll), an Event, a comment, a chat message, a Moments photo and a user's profile; a Community can be reported from its menu by its members. Anyone can report anything — including a Community they are not a member of — via the form at amista.app/support. When reporting in the app, you choose a reason — spam or scam, harassment or bullying, hate speech, violence or threats, nudity or sexual content, sexual content involving a minor, self-harm or suicide, illegal or dangerous, something else — and you can add your own description. Outside the app you can also submit a report by email — Content concerning minors to safety@amista.app, other illegal Content to legal@amista.app. When reporting via the form or by email, provide a sufficiently precise identification of the Content (for example, a link), the reason why you consider it illegal or in breach of these Terms, and your name and email address. Also include a statement that you are giving the information in good faith and that, to your knowledge, it is accurate and complete. For sexual content involving a minor you do not have to give your name or email address.

We will confirm receipt of the report. Once we have reviewed it, we will tell you without undue delay what we decided about the reported Content (removed, hidden or no action), whether we used automated means in doing so, and what redress is available to you (a complaint to appeals@amista.app under Article 7.5, the courts, and the Council for Media Services as the Digital Services Coordinator). We do not disclose measures taken against the author's Account. We assess reports in a timely, non-arbitrary and objective manner and with due diligence; the assessment is carried out by a human.

We do not disclose the reporter's identity to the reported person. We tell a Community's admins that Content in their Community was reported, without saying who reported it.

7.3Automated measures

Only the following moderation measures are fully automated:

  1. If the same post, Event, comment, chat message or Moments photo is reported by three different users within 7 days, the Service automatically hides it temporarily and queues it for priority review. Only reports from Accounts older than 3 days whose reports have not been excluded for misuse (Article 7.6) count. We may adjust these thresholds; we will mark the change in this Article and announce it in accordance with Article 17.
  2. Content listed in point 1 that is reported with the reason “Sexual content involving a minor” is hidden immediately after the report is submitted and preserved in such a way that it cannot be deleted (a legal hold) until it has been reviewed by a human (see the Child Safety Standards). This does not apply to reports from users whose reports we do not count because of misuse (Article 7.6).
  3. Prohibited-words filter. The Service does not accept a username, a Community name or an Event name that contains a term from the list of prohibited words.

The measures under points 1 and 2 are temporary, reversible and always followed by human review. Accounts and Communities are never restricted automatically — a report only places a reported profile or Community in the queue for review, as a priority for the reason “Sexual content involving a minor”.

Where we suspect a criminal offence involving a threat to the life or safety of a person, in particular the sexual abuse of a child, we report it to law enforcement authorities without delay (Art. 18 DSA).

7.4Measures we may take

If Content or conduct breaches the law or these Terms, we may, depending on the severity and with regard to proportionality:

  1. hide (a reversible measure) or remove Content, or delete an inappropriate name, title, description, bio or image;
  2. warn the user;
  3. suspend the Account for 24 hours, 7 days, 30 days or permanently — a suspended Account cannot write or post anything, it is signed out, and its Content (posts, Events, chat messages, comments, Moments photos) and calling card are hidden from others;
  4. delete the Account in the event of a serious or repeated breach;
  5. deactivate a Community if the breach relates to it as a whole, transfer ownership of a Community to another member or revoke invitation links to it.

Every measure is recorded on the Account as a violation; a warning says which violation it is. When choosing a measure, we take into account the nature and severity of the breach, whether the conduct is repeated, and the consequences of the measure for the user. The measures under this Article are always decided by a human and are reversible, except for deletion of the Account. We keep removed Content for 30 days so that we can restore it after a successful complaint; we then delete it permanently. A removed profile picture or Community image is deleted at once, unless it is subject to an open child-safety report or a legal hold. We preserve Content under a legal hold (in particular Content reported as sexual content involving a minor, Article 7.3(2)) — even if its author deletes it or their Account — until we release the hold, i.e. until we have reviewed it and, if the suspicion is confirmed, for as long as an investigation or cooperation with law enforcement authorities requires; until then we also postpone the deletion of such an Account or Community. Hidden Content stays hidden until we have reviewed it.

7.5Statement of reasons and complaint

We will inform you of any measure taken in the app (an in-app notice and a notification) and give you a statement of reasons (Art. 17 DSA). The statement of reasons always contains:

  1. the measure we took, its scope and its duration;
  2. the facts on which it is based, and whether we acted on a report or on our own initiative;
  3. whether we used automated means in taking it;
  4. the provision of these Terms or of the Community Guidelines, or the law, that was breached, with an explanation of why;
  5. the redress available to you — a complaint under this Article, the courts and the Digital Services Coordinator.

You can lodge a complaint (appeal) against any measure by email to appeals@amista.app or via the form at amista.app/support, within 6 months of receiving the statement of reasons. The complaint will be reviewed by a person — usually someone other than the one who took the original decision — and we will inform you of the outcome without undue delay, usually within 7 days. If the measure was unjustified, we will reverse it without delay; we can restore removed Content if no more than 30 days have passed since its removal (Article 7.4). We provide this procedure voluntarily; as a micro or small enterprise, we are not subject to the obligations under Section 3 of Chapter III of the DSA (Art. 19 DSA).

This does not affect your right to go to court or to turn to the Digital Services Coordinator — in the Slovak Republic, the Council for Media Services (Rada pre mediálne služby, rpms.sk).

7.6Misuse of reporting

If you repeatedly submit manifestly unfounded reports, our team may flag your Account as misusing reporting. For 90 days — permanently in the case of repeated misuse — we then do not count your reports towards automatic hiding, and they do not trigger immediate hiding under Article 7.3(2) either; we still see and assess them.

7.7Requests from public authorities

If an order from a public authority requires us to act against specific Content or to provide information, we act within the scope of the order and inform the user concerned, unless we are prevented from doing so by law or by the order itself (Arts. 9 and 10 DSA).

7.8Point of contact

The single electronic point of contact (Arts. 11 and 12 DSA) for users is the email address given in Article 1 and the form at amista.app/support; for Member State authorities, the European Commission and the European Board for Digital Services, it is legal@amista.app. You can communicate with us in Slovak, Czech and English.

7.9Infringement of intellectual property rights

If you believe that Content in the Service infringes your copyright, trade mark right or other intellectual property right, notify us at legal@amista.app. In the notice, state:

  1. identification of the right allegedly infringed (for example, the work, the trade mark, the registration number);
  2. the exact identification of the Content allegedly infringing the right — in particular a link or a description sufficient for us to find it;
  3. your identification and contact details and whether you are acting as the rights holder or on their behalf;
  4. a statement that, in good faith, you consider the use of the Content to be unauthorised and that the information in the notice is true and complete.

We will handle the notice under the procedure set out in Articles 7.2, 7.4 and 7.5. We will inform the user whose Content the notice concerns, and they may submit a counter-notice; if it shows that the Content does not infringe the right, we will restore it.

Repeat infringers. If we repeatedly remove a user's Content for infringement of intellectual property rights, we will suspend their Account and, upon a further infringement, delete it. The decision is always taken by a human and is subject to the complaint procedure under Article 7.5.

8Communities, roles and admins

  • A Community is set up by a user, who becomes its owner. The owner may appoint admins and determine what members may do.
  • The owner and admins decide on admitting and removing members, on Content in the Community and on its settings. These decisions are their own and we do not interfere with them, except in the cases under Article 7.
  • The owner and admins are responsible for ensuring that the Community, its name, description, images and rules do not breach the law or these Terms.
  • An owner can delete their Account at any time. If they own a Community that has other members, they first hand it over to another member or delete it — both in the Community's settings in the app (Article 16.1).
  • If a Community is deactivated or deleted, it also ceases to be available to its members, including the Content stored in it. A Community deleted by its owner can be restored for 3 days; after that we delete it with all its Content.
  • If the owner moves to a Plan that does not cover all their Communities, a Community may be locked and deleted after 30 days together with the members' Content (Article 11.4). We will notify members in advance, and they can download the photos.

9Events — the relationship between organiser and participant

  1. Events are created and organised by users, not by us. Any contractual or other relationship arises directly between the Organiser and the participant. We are not a party to it, an intermediary or an agent.
  2. The Organiser is responsible for the accuracy of the Event details (time, place, capacity, price, conditions of participation), for how it runs and its safety, and for fulfilling all obligations imposed on them by law — including obligations relating to consumer protection, taxes, fees for the use of musical works and notification obligations.
  3. Admission fees and other payments for Events are not made through the Service. If a price is shown for an Event, it is for information only — the Organiser and the participant settle payment outside the Service. We do not accept payments for Events, issue receipts for them or handle complaints or refunds of admission fees.
  4. Confirming attendance or interest, or signing up for a course, in the Service is an expression of intent towards the Organiser; we do not guarantee a place or participation. The Organiser may change or cancel the Event.
  5. If you share an invitation link, you make the Event or Community available to anyone who receives the link. You are responsible for the extent of the sharing.

10Safety when using the Service and at meet-ups

Amista brings people together in the real world. That is why it is important that you know what we do for you and what we do not.

10.1We do not verify identity

We do not verify the identity of users, Organisers or Communities, we do not carry out any checks of criminal records, qualifications, licences or insurance, and we do not check whether an Event actually exists and will take place as described. A profile in the Service is no guarantee of who that person is.

10.2Meet-ups are at your own risk

You attend Events and meet people from the Service at your own risk. In particular, we recommend that you:

  • meet for the first time in a public place;
  • tell someone close to you where you are going and with whom;
  • do not send money, deposits or documents to people you do not know;
  • do not share login credentials, copies of identity documents or sensitive personal data;
  • report suspicious behaviour directly in the app (Article 7.2).

10.3Venue and location

The location of an Event, including its geographic coordinates, is visible to the audience chosen by the Organiser. Do not enter your home address as the Event location unless you are making the Event available only to people to whom you want to reveal it. Other users do not see the coordinates of your home area; its name is shown on your calling card only if you turn that on.

10.4Health and physical activity

Events may involve physical activity or activities carrying a risk of injury. We do not provide medical, sports or other professional advice, and Content in the Service is no substitute for it. You are responsible for assessing whether participation is suitable for you; where appropriate, consult a doctor.

10.5Emergencies

The Service is not an emergency line. In the event of an immediate threat to life, health or property, call the emergency number 112 (or 158 — police, 155 — ambulance, 150 — fire brigade) or contact the local authorities. A report in the app is no substitute for reporting to law enforcement authorities.

10.6Protection of minors

Only persons aged 16 or over may use the Service (Article 3.1). We recommend that legal representatives talk to younger people about the risks of meeting strangers. Report any suspicion of conduct that endangers a minor to us without delay — we handle such reports as a priority.

11Plans

11.1What a Plan determines

A Plan belongs to your Account, not to a particular Community. It determines two things: how many Communities you can own and how many Events you can organise in one calendar month. Nothing else changes with the Plan.

PlanCommunities you can ownEvents in one month
Amista (free)310
Amista+550
Amista Pro201,000
  1. Only Communities that you own count towards the Community limit — not those in which you are a member or admin.
  2. Events are counted by the month in which they take place, not by when you created them. Each date of a recurring Event and each course session counts separately.
  3. The Plan does not limit the number of members of a Community.
  4. The current scope and prices of the Plans are shown by the Service and the Store before you confirm a purchase.
  5. A Plan belongs to a single Account and cannot be shared through Apple Family Sharing or the Google Play Family Library.
  6. We will not worsen the limits of a paid Plan during the paid period; if we had to reduce them for a serious reason (legal requirements, security, abuse), we will announce it in advance, and you may terminate the contract free of charge with a refund of the pro rata part of the price under Article 17.

11.2Purchase, price and renewal

  1. Plans are purchased exclusively as an in-app purchase through the App Store or Google Play. You conclude the purchase contract with the operator of the relevant Store, which is the seller, processes the payment and issues the receipt. We do not receive or store your payment details.
  2. Prices are shown in the Store inclusive of value added tax. The price shown in the Store at the time you confirm the purchase is decisive.
  3. You can choose a subscription for a month or a year, and it renews automatically for the same period until you cancel it. Renewal takes place in accordance with the Store's rules, usually 24 hours before the end of the current period. If payment for a renewal fails, you keep the Plan during the Store's grace period, in which the Store keeps retrying the payment; if the payment still does not go through, the subscription ends in accordance with Article 11.4.
  4. You cancel the subscription in your account settings in the Store, not in the app. After cancellation, the Plan remains active until the end of the paid period.
  5. Changing Plans. Upgrading to a higher Plan in the app replaces your existing subscription in the same Store and takes effect immediately; the Store settles the price difference for the rest of the period under its own rules. You move to a lower Plan in the App Store in the subscription settings (effective from the next period), and in Google Play by cancelling your existing subscription and buying the lower Plan after it ends. A subscription purchased in one Store cannot be changed in the other; while it is renewing there, the app will not sell another Plan in the other Store, so that you do not pay twice.
  6. We use the RevenueCat service to verify the status of subscriptions. Activation of a higher Plan may take a short time after purchase; if the purchase is not reflected, use the “Restore purchases” feature in the app or contact us.
  7. Price changes. We may change the price. The Store will notify you of an increase in advance, usually at least 30 days ahead; the new price applies only from the next period and, where the Store or the law requires it, only with your consent. If you do not agree, cancel the subscription free of charge before the change takes effect.

11.3A Plan from us

We may also give you a paid Plan free of charge — for example, as part of a partnership or as compensation. Such a Plan is valid until the date you will see in the app (or until we end it), you pay nothing for it and nothing renews automatically. When it ends on that date, we will let you know; if we end it earlier, we will usually let you know.

11.4End or downgrade of a Plan

  1. If your subscription ends, a Plan from us expires or we end it, or you move to a lower Plan, the limits of the new Plan apply from the day of the change. While the Store is still retrying the payment during its grace period, this is not a downgrade — you keep the Plan until the end of that period (Article 11.2(3)). A refund or a withdrawal from the purchase ends the Plan immediately, and the lower Plan's limits apply. If you cancel your subscription and your Communities would exceed the lower Plan's limit once it ends, we will let you know.
  2. Events. The new limits apply to what you create from then on: you cannot add new Events to a month that already has the full number of Events. Events that already exist remain.
  3. Communities — choice. If you own more Communities than the new Plan allows, you choose within 7 days which ones to keep (at most as many as the new Plan allows). Until you choose, nothing is locked, but you cannot set up a new Community. If you do not choose within 7 days, we will keep those with the most recent activity (latest Event, post or photo) and lock the rest. You can change your choice up until the deletion date.
  4. A locked Community is restricted for 30 days for everyone, including you: no new post, poll, comment, Event or photo can be added to it, no one can be invited to it or join it, and it does not appear in discovery, on the map or in search. Responses to Events, voting in polls, hearts and Event chats keep working. Members can still see it, Events dated before the deletion date can take place, and every member can download photos from the Events they attended or organised (the owner and admins from all of the Community's Events). The download link is valid for 24 hours and anyone who has it can open it — do not send it to anyone. We will notify you and the members of the locking and remind you of the deletion 7 days and 1 day in advance.
  5. Deletion. 30 days after the first locking, we permanently delete the Community together with the Content in it — posts, comments, polls, Events and photos. One Plan downgrade has one deletion date; changing your choice does not move it. Events dated after the deletion date will not take place; we will alert their participants to this at the time of locking.
  6. Return. If, before the deletion date, you again have a Plan whose limit covers all your Communities — by purchase or from us (Article 11.3) — we will unlock all locked Communities at once. After deletion, they cannot be restored.
  7. You can also delete a locked Community yourself at any time. In exceptional cases we may move the deletion date later, never earlier.

11.5Complaints and refunds

  1. In addition to your rights against the Store, we undertake that a paid Plan will work as described for the whole subscription period. This does not affect your statutory rights. Report a defect to support@amista.app; we will confirm receipt without delay by email, with a time limit for remedying it of no more than 30 days, and give written reasons for any rejection. If we do not remedy the defect, you are entitled to a reasonable price reduction for the time the Plan did not work, or you may withdraw and we will refund the pro rata part of the price for the unused period — for Google Play through Google Play, for the App Store by bank transfer, or, with your consent, by extending the Plan free of charge.
  2. The seller is Apple Distribution International Ltd. (App Store) or Google Commerce Limited (Google Play). Ask them for a refund or to withdraw from the purchase: App Store — reportaproblem.apple.com; Google Play — Order history → Report a problem (within 48 hours), after that write to us at support@amista.app and we may refund you through Google Play.
  3. Cancelling a subscription does not refund the price for the current period.

12Withdrawal from the contract (consumers)

If you are a consumer, you have the right to withdraw from a contract concluded at a distance within 14 days without giving any reason; the period runs from the conclusion of the contract under Article 3.2. Notify us of your withdrawal at the contact address given in Article 1 — you may use the model form in Annex B, but it is not mandatory. It is sufficient to send the notice before the period expires.

Withdrawal from the free contract has the same effect as deleting your Account under Article 16.1, which you can do at any time.

For paid Plans, Article 11.5 applies: you conclude the purchase contract with the Store and exercise the right of withdrawal with it.

13Availability of the Service and changes to it

  1. We provide the Service with professional care, but we do not guarantee its uninterrupted availability. We may interrupt operation for the time necessary due to maintenance, an update, a security incident or an outage on the part of infrastructure providers. We will announce planned downtime with a significant impact in advance where possible.
  2. We continuously develop the Service. We may add, change and remove features. If a change would materially impair access to or use of the Service, we will announce it reasonably in advance in accordance with Article 17. If you have a paid Plan and a change worsens your position more than insignificantly, you have the rights under Article 17. We will not worsen the limits of a paid Plan during the paid period; the exception and your rights are set out in Article 11.1(6).
  3. To use the Service, you need a compatible device, an up-to-date operating system and an internet connection. You bear the costs of the connection and data. We may limit support to the current and previous major version of the app.
  4. Test and trial features. We may make some features available as test features (“beta”). They are always labelled or offered as optional and may be unstable or incomplete; do not keep important Content in them as your only copy. This does not affect our statutory liability. We may change or withdraw a test feature at any time, even without prior notice, and the availability commitment under point 1 does not apply to it. This does not affect your statutory consumer rights in relation to paid Plans.

14Intellectual property of the Service

The app, its source code, design, interface, graphics, texts, branding and the name “Amista”, and all parts of them, are protected by intellectual property law and belong to us or our licensors.

We grant you a non-exclusive, non-transferable, worldwide right to use the app for your own purposes in accordance with these Terms, for the duration of the contract. You must not copy, modify, reverse engineer, decompile or rent out the app or create derivative works from it, except where expressly permitted by mandatory law.

The Service contains third-party components and content — in particular map data, the GIF catalogue, sign-in with a Google or Apple account and notification delivery. The terms of those third parties may also apply to their use. We are not responsible for the content of external websites linked from the Service.

15Liability

  1. We are liable for damage in accordance with general legal regulations. Nothing in these Terms limits our liability for damage caused intentionally or for damage to health, or the statutory rights of consumers — in particular rights arising from liability for defects in a digital service.
  2. We are not liable for users' Content to the extent provided in Art. 6 DSA, i.e. where we have no knowledge of its illegality or, once we become aware of it, remove it or disable access to it without delay. Nor are we liable for the conduct of users, Organisers and Community admins, or for the course, cancellation or consequences of Events (Articles 9 and 10).
  3. We are not liable for damage caused by your breach of these Terms or the law or by your failure to protect your login credentials, or for damage caused by an outage that we could not prevent (for example, an outage of an infrastructure provider, the network or the Store, or force majeure).
  4. For both free and paid use of the Service, we are liable for damage to the extent provided by law.
  5. If a third party or a public authority brings a claim against us as a result of your culpable breach of these Terms, you must compensate us for the proven damage incurred as a result, including reasonably incurred costs of legal representation.

16Term and termination of the contract

16.1Termination by you

You can terminate the contract at any time and without giving a reason by deleting your Account in the app under Settings or on our website, after signing in, under Account. After you request deletion, the Account is hidden and suspended for 7 days; if you change your mind, simply sign in to the app during this period and cancel the deletion (this is not possible on the website). Your Account, profile, settings, social connections and Content linked to the Account, including your chat messages, are then removed, to the extent, with the exceptions and within the time limits set out in Article 6.3 and the Privacy Policy. Events you organised are deleted in full — including their chat, the participants' responses and the photos, including those uploaded by others. Reports you have filed are kept without your identity. We will delete a suspended Account upon a request sent to privacy@amista.app.

If you own a Community that has other members, hand it over to another member or delete it before deleting your Account — you can do both in its settings in the app. The app reminds you of this when you delete your Account.

Deleting your Account does not cancel your subscription in the Store — you must cancel it separately under Article 11.2(4); a subscription you do not cancel will keep renewing. Unused time of a paid Plan is forfeited when the Account is deleted, except where you terminate the contract because of a change under Article 17.

16.2Termination by us

We may terminate the contract with one month's notice without giving a reason, in particular if we discontinue the Service or part of it. We will send the notice to the email address linked to your Account.

We may delete your Account or suspend access with immediate effect if you seriously or repeatedly breach these Terms or the law, if this is required by law or by a decision of a public authority, or if it is necessary to prevent imminent harm to other users or to us. We will inform you of the reasons in accordance with Article 7.5, and you may lodge a complaint.

16.3Consequences of termination

Upon termination of the contract, your right to use the Service ends. If we terminated the contract without any breach on your part and you had a paid Plan, we will refund you the pro rata part of the price for the unused period; we refund it ourselves — for Google Play through Google Play, for the App Store by bank transfer.

Provisions which by their nature are intended to survive the end of the contract (in particular Articles 6.3, 14, 15 and 19) remain in force.

17Changes to the Terms

We may amend these Terms if the Service, the law or the conditions under which the Service is provided change.

We will notify you of a material change in advance — in the app or by email — at least 15 days before it takes effect. If you do not agree with the change, you may terminate the contract free of charge before it takes effect by deleting your Account under Article 16.1. If you continue to use the Service after the change takes effect, you have accepted the change.

Paid Plan. If you have a paid Plan and a change to the Terms or to the Service (Articles 13.2 and 20.5) worsens your position more than insignificantly, we will also notify you of it by email, and within 30 days of the notice or of the change, whichever is later, you may terminate the contract free of charge; we will refund the pro rata part of the price for the unused period in the manner set out in Article 16.3, and the Plan time is not forfeited.

Changes that do not worsen your position (for example, clarification of wording, correction of errors, addition of a new optional feature) take effect upon publication.

18Personal data protection

Which personal data we process, for what purposes, on what legal basis, to whom we disclose them and what rights you have are described in the Privacy Policy (amista.app/privacy). The Privacy Policy is not part of the contract; it describes how we process your data.

19Governing law, disputes and alternative resolution

  1. Our relationship is governed by the law of the Slovak Republic, in particular Act No. 40/1964 Coll., the Civil Code, Act No. 22/2004 Coll. on Electronic Commerce and — if you are a consumer — Act No. 108/2024 Coll. on Consumer Protection. If you are a consumer habitually resident in another Member State of the European Union, the choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country of your habitual residence (Art. 6 of Regulation (EC) No 593/2008 — Rome I).
  2. We will try to resolve disputes by agreement. Please contact us first at the address given in Article 1 — we will handle a claim or complaint without undue delay, and at the latest within 30 days of receipt. If you believe that we have infringed your rights, send us a request for redress at support@amista.app.
  3. If you are a consumer and we reject your request for redress or do not reply to it within 30 days, you may, within one year, submit an application for alternative dispute resolution (Section 11 of Act No. 391/2015 Coll. on Alternative Dispute Resolution of Consumer Disputes) to the Slovak Trade Inspection (SOI) — Central Inspectorate, Department of International Relations and Alternative Consumer Dispute Resolution, Bajkalská 21/A, 827 99 Bratislava 27, www.soi.sk — or to another body on the list kept by the Ministry of Economy of the Slovak Republic. An application may also be submitted electronically.
  4. Otherwise, the courts of the Slovak Republic have jurisdiction over disputes. If you are a consumer, this does not affect your right to bring proceedings before the courts of the country where you are domiciled and your right to be sued only there (Arts. 17 to 19 of Regulation (EU) No 1215/2012 — Brussels Ia).

20Final provisions

  1. These Terms, including Annex A and Annex B, constitute the entire agreement between you and us regarding the use of the Service and supersede previous arrangements on the same subject matter. This does not affect your statutory rights.
  2. These Terms do not create a joint venture, commercial agency, employment or similar relationship between you and us.
  3. If any provision of these Terms becomes invalid or ineffective, the remaining provisions remain in force, and the invalid provision will be replaced by one that comes closest to its purpose. Towards a consumer, an invalid provision is not replaced; the statutory rules apply.
  4. If we do not exercise any of our rights immediately, this does not mean that we waive it.
  5. You may not assign your rights and obligations under the contract to a third party without our consent. We may assign them to a legal successor in the event of a sale of the business, a merger or a similar transaction; if this would worsen your position, we will notify you in advance and you may terminate the contract under Article 16.1; if you have a paid Plan, Article 17 also applies.
  6. Communication takes place electronically — from us to the email address linked to your Account or by a notice in the app, and from you to the address given in Article 1. You consent to communication in electronic form.
  7. These Terms are drawn up in the Slovak language. If we also publish a translation, the Slovak version prevails, unless mandatory law provides otherwise.
  8. These Terms take effect on the date stated in their header and supersede all previous versions.

Annex A — Special terms for the App Store and Google Play

A.1App downloaded from the App Store (Apple)

If you downloaded the app from the App Store, the following also applies in addition to these Terms. In the event of a conflict, this Annex prevails to the extent of that conflict.

  1. Parties. These Terms are concluded between you and us, not with Apple Inc. or its subsidiaries (“Apple”). We alone are responsible for the app and its content.
  2. Scope of licence. The licence under Article 14 of these Terms is a non-transferable licence to use the app on Apple-branded devices that you own or control, in accordance with the Usage Rules set out in the Apple Media Services Terms and Conditions.
  3. Maintenance and support. Apple has no obligation whatsoever to provide maintenance or support services for the app. We provide support at the contact address given in Article 21.
  4. Warranty. To the maximum extent permitted by law, Apple has no warranty obligation whatsoever with respect to the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. We are responsible for defects and for claims arising from them, in accordance with Articles 11.5 and 15.
  5. Claims relating to the app. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or its use — including product liability claims, claims that the app fails to conform to any applicable legal requirement, and claims arising under consumer protection and data protection legislation.
  6. Intellectual property rights. If a third party claims that the app or your use of it infringes that third party's intellectual property rights, we, not Apple, will be responsible for the investigation, defence, settlement and discharge of any such claim.
  7. Export compliance statement. You represent that (a) you are not located in a country that is subject to a United States Government embargo or that has been designated by the US Government as a terrorist-supporting country, and (b) you are not listed on any list of prohibited or restricted parties maintained by the US Government.
  8. Apple as third-party beneficiary. You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms and that, upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
  9. Questions and complaints. Direct any questions, complaints or claims relating to the app to the contact address given in Article 21.

A.2App downloaded from Google Play

If you downloaded the app from Google Play, the contract for the use of the app is concluded between you and us; Google is not a party to it and is not responsible for the app. The download of the app and purchases within it are also governed by the Google Play Terms of Service. We provide support in accordance with Article 21.
